Suit brought by a commercial firm challenged the legality of a state's financial responsibility requirements, which were designed to effectively preclude the permitting of a hazardous waste landfill facility. An expert affidavit was provided regarding the fact that such financial responsibility requirements were inconsistent with RCRA's basic provisions. This case has been resolved in a manner satisfactory to the client.
